Regulations for making donations

I. Introductory Provisions

  1. These regulations (hereinafter referred to as the "Regulations") define the principles of provision by the Rakiety Oncological Foundation, al. Rzeczypospolitej 2/U-2, 02-972 Warsaw, KRS 0000414091 (hereinafter referred to as the "Foundation") of an electronic service, consisting in enabling persons using the website www.fundacjarakiety.pl or www.gwiazdozbior.pl and their subpages (hereinafter referred to as the "Website") to make cash donations for the statutory activities of the Foundation.
  2. Whenever these Regulations refer to a donor, this should be understood as any person using the Website to make a donation (hereinafter referred to as the "Donor").
  3. By using the Website to make donations, the Donor declares and confirms that he/she has read the Regulations and accepts their provisions.
  4. The current version of the Regulations is always available to Donors on the Website.

II. Rules for making donations on the website

  1. A donation can be made after filling in the data and clicking "I support" on the Site. After clicking, follow the further instructions provided to the Donor by the IT system.
  2. Donations are transferred via the payment operator – PayU SA with its registered office in Poznań, 60-166 Poznań, ul. Grunwaldzka 186 (hereinafter: "Payment Operator").
  3. Donations can be made via electronic transfer and the BLIK mobile payment system.
  4. Donor contributions are protected by a secure SSL certificate. All transmitted information is encrypted.
  5. When making a donation, the Donor can pay one of the amounts suggested on the website or any amount they specify.
  6. One-time and recurring donations can be made through the website.
  7. Donors have the right to request a refund of a donation within 7 days of its payment. To request a refund, send an email to: [email protected]. In the subject line of the email, please provide your name and surname and include the words "Resignation from donation".
    The donation will be refunded within a maximum of 30 days from the date of cancellation.

III. Regular donations in the form of recurring payments

  1. By choosing to make a donation in the form of a recurring payment, the Donor decides to have the Payment Operator collect from their payment card each month an amount of money corresponding to the amount of the Donation they have selected or entered.
  2. The recurring donation will be collected by the Payment Operator once a month.
  3. As part of the recurring payment service, the donor has the option to save card details and a standing order for direct debit. Card details are stored by the payment operator.
    The payment operator, acting as an intermediary in making the payment, provides a Token for recurring payments (virtual card identifier), which enables assigning a unique identifier to an individual Donor, by means of which the Donor periodically makes payments to the Foundation.
  4. The Foundation does not collect or process in its IT system data from Donors' payment cards (credit or debit). The Donor provides this data only to Payment Operators.
  5. Donor data, title, and payment amount are provided to the payment operator by the Foundation. The order is forwarded for registration after the payment operator receives the payment.
  6. The payment operator does not charge the Donor for the service. The entire amount of the donation goes to the Foundation's account. The payment operator charges the Foundation a commission and additional fees.
  7. If there are no funds in the account or the authorization limit is too low, the declared amount will not be collected.
  8. On the day the Donor's card expires, the card will stop being charged and donations will not be collected. The Donor can make further donations after renewing the card and re-establishing regular payments on the website using the new card.

  10. The donor may cancel the recurring payment at any time. To do this, contact the Foundation's office by sending an email to [email protected]. Please title the email "resignation from support" and provide your name, surname, and the email address used when completing the regular support.

IV. Fees

The Foundation does not charge the Donor any commission on Donation payments.

V. Tax exemptions
In accordance with the provisions of the law, Article 26, Section 1, Item 9 of the Personal Income Tax Act, it is possible to deduct the value of donations from income in the tax year. Donations made to the Foundation's activities can be deducted from income: a natural person up to an amount equal to 6% of income before taxation (Article 26, Section 1, Item 9 of the Personal Income Tax Act), and a legal person up to an amount equal to 10% of income before taxation (Article 18, Section 1, Items 1 and 7 of the Corporate Income Tax Act).
Confirmation of the transfer must be kept for 5 years from the date of the donation.

VI. Complaints, returns

  1. If there are any problems with making a donation, please report them to the Foundation at [email protected].
  2. The Donor may file a complaint directly with the Payment Operator if the services specified in the Payment Operator’s regulations have not been performed or are performed contrary to its provisions.

VII. Personal data of donors

  1. The Foundation is the controller of the personal data of Donors and undertakes to protect this data in accordance with the General Data Protection Regulation of 27 April 2016 (OJ EU L 119 of 04.05.2016, hereinafter referred to as: "GDPR") and the Act on the provision of services by electronic means (Journal of Laws of 2024, item 1513).
  2. Providing your data is voluntary, but necessary to make a donation.
  3. By making a donation, the Donor acknowledges that the processing of personal data is for the purpose of implementing the donation agreement (Article 6, paragraph 1, letter b of the GDPR), handling the donation in accordance with applicable law (Article 6, paragraph 1, letter c of the GDPR). Personal data may also be used for correspondence, sending thanks to the Donor for the payment, contacting the Donor in the event of problems with handling the donation or to confirm receipt of payment (Article 6, paragraph 1, letter f of the GDPR).
  4. Donors' personal data are processed for the purpose of fulfilling the contract until the claims expire (6 years), and for the purpose of fulfilling legal obligations for the period provided for in the Accounting Act (7 years), for the purpose of sending thanks and managing relationships (until an objection is filed or for a period of 2 years) from the time of the last interaction (payment).
  5. The Foundation may collect the following data: first name, last name, e-mail address, mailing address, telephone number and amount of donation – if the Donor has provided this data.
  6. Donors have the right to request access to their data, its correction, deletion or restriction of processing. To do this, please report the information to the following address: [email protected] or by traditional mail to the Foundation's registered office. If the Donor believes that their rights have been violated, they may file a complaint with the President of the Personal Data Protection Office.
